Basketball Alpha Terms of Service

1. Acceptance of Terms

These Terms of Service govern your access to and use of Basketball Alpha websites, applications, tools, and related services. By accessing or using Basketball Alpha, you agree to these Terms. If you do not agree, do not use the service.

These Terms are a binding agreement between you and Overround LLC, a Kansas limited liability company doing business as Basketball Alpha ('Basketball Alpha,' 'we,' 'us,' or 'our').

2. Description of Service

Basketball Alpha is a customer-facing NBA analytics and information platform for official injury status, sourced reporting, confirmed lineups, rotations, player-role context, team and game research, historical comparisons, scenarios, and lines research.

Basketball Alpha is not a sportsbook, sports betting operator, casino, gambling service, payment custodian, contest, or bet placement service. Basketball Alpha does not accept wagers, does not hold funds for wagering, does not transmit bets, does not place bets on your behalf, does not award prizes, and does not guarantee results or winnings.

3. Eligibility and Legal Compliance

• You must be at least 21 years of age and old enough to form a binding contract.
• If you use Basketball Alpha in connection with sports betting decisions, you must be of legal wagering age in your jurisdiction and located where your activity is lawful.
• You are solely responsible for determining whether your use of Basketball Alpha is legal where you are and for understanding and complying with the gambling and other laws, rules, and regulations of your jurisdiction that apply to you and your use of Basketball Alpha.
• We may restrict or terminate access if we believe use may violate these Terms, applicable law, or platform security requirements.

4. Informational Use Only; No Advice

Basketball Alpha provides NBA data, historical comparisons, analytics, and visualizations for research, informational, and entertainment purposes only. The service does not provide betting or gambling advice, financial advice, legal advice, tax advice, or a recommendation that you place any wager.

Sports outcomes are uncertain. No data point, historical comparison, scenario, line, or research result guarantees winnings, profit, or any particular result. Past or historical performance does not predict future results. You are solely responsible for decisions you make based on information from Basketball Alpha.

5. Accounts and Security

• You are responsible for maintaining accurate account information and keeping your login credentials secure.
• You are responsible for activity that occurs under your account.
• You may not share, sell, transfer, or sublicense account access without written permission from Basketball Alpha.
• You must notify us promptly if you believe your account has been accessed without authorization.

6. Plans, Access, and Payments

Basketball Alpha Pro costs $14.99 USD/month, plus any applicable taxes. It is a recurring digital subscription that renews automatically each month until canceled. Paid Pro access is fulfilled immediately after a successful first payment. There is no shipping, physical delivery, or physical return process.

Eligible first-time customers may start one 14-day cardless trial. No payment method is required to begin, the trial does not automatically convert into a paid subscription, and no charge occurs unless you later choose to subscribe or add a card during an active trial. If you add a card during an active trial, the original trial end remains unchanged and the first charge is scheduled for that date.

Cancel through Account Billing and the Stripe billing portal before the next renewal to stop that renewal. Cancellation takes effect at the end of the current paid period, and Pro remains available through the paid-through date. You may resume before that date where the portal offers that option.

Subscription fees are generally nonrefundable after digital access is granted, except where required by law. If we confirm a duplicate or erroneous charge, we will refund it to the original payment method. Contact [email protected] about a charge you believe is duplicate or erroneous. We do not provide prorated refunds for unused time after a routine cancellation unless required by law.

Stripe Checkout securely collects and processes payment details. Basketball Alpha does not receive or store full card numbers. The card networks shown before checkout reflect the networks enabled for that checkout.

We may modify plan features, access rules, prices, promotional access, or availability prospectively, subject to applicable law and any specific written terms provided to you. We will present the applicable price before purchase.

7. Third-Party Odds, Data, and Services

Basketball Alpha may display or process odds, lines, scores, box scores, player information, projections, sportsbook references, and other data from third-party sources. Third-party data may be delayed, incomplete, inaccurate, unavailable, or different from information shown by a sportsbook or data provider at the time you act.

You should verify current odds, lines, rules, market status, and wager details directly with the applicable licensed sportsbook before placing any wager. Basketball Alpha is not responsible for third-party websites, sportsbooks, data providers, or services.

8. Acceptable Use

• Do not violate law or use Basketball Alpha for unlawful, fraudulent, abusive, or harmful activity.
• Do not scrape, crawl, harvest, bulk export, resell, redistribute, or commercially exploit Basketball Alpha content or data without written permission.
• Do not interfere with, overload, probe, reverse engineer, bypass, or attempt unauthorized access to Basketball Alpha systems, models, security controls, or accounts.
• Do not use Basketball Alpha to build, train, or enhance a competing product or service without written permission.
• Do not upload malware or attempt to disrupt the service.

9. Intellectual Property

Basketball Alpha and its licensors own the service, software, interfaces, designs, models, analytics, content, compilations, trademarks, and other materials made available through the service. Subject to these Terms, Basketball Alpha grants you a limited, revocable, non-exclusive, non-transferable right to access and use the service for your personal or internal research use.

You retain responsibility for information you enter into your account. You grant Basketball Alpha the rights needed to host, process, display, secure, analyze, and operate that information as part of providing the service.

Neither Basketball Alpha nor Overround LLC is affiliated with, endorsed by, or sponsored by the National Basketball Association (NBA), the Women's National Basketball Association (WNBA), any NBA or WNBA team, or any sportsbook. All league, team, sportsbook, and other third-party names, logos, and trademarks are the property of their respective owners.

10. Termination

You may stop using Basketball Alpha at any time. We may suspend, restrict, or terminate access at any time if we believe you violated these Terms, created risk, failed to pay applicable fees, or used the service in a way that may harm Basketball Alpha, other users, or third parties.

After termination, provisions that by their nature should survive will survive, including intellectual property, disclaimers, limitation of liability, indemnity, dispute, and general provisions.

11. Disclaimer of Warranties

Basketball Alpha is provided "as is" and "as available." To the maximum extent permitted by law, Basketball Alpha disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, reliability, and profitability.

We do not warrant that Basketball Alpha will be uninterrupted, error-free, secure, current, complete, or free from harmful components, or that any analytics, projections, odds, alerts, or data will be accurate or profitable.

12. Limitation of Liability

To the maximum extent permitted by law, Overround LLC, doing business as Basketball Alpha, and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including lost profits, lost revenue, lost data, financial losses, betting losses, or business interruption, even if advised of the possibility of such damages.

To the maximum extent permitted by law, Basketball Alpha's total aggregate liability for all claims relating to the service or these Terms will not exceed the greater of the amount you paid to Basketball Alpha for the service in the twelve months before the claim or one hundred dollars ($100).

13. Indemnification

You agree to defend, indemnify, and hold harmless Overround LLC, doing business as Basketball Alpha, and its owners, officers, employees, contractors, affiliates, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from or related to your use of Basketball Alpha, your violation of these Terms, your violation of law, your user-entered information, your infringement of third-party rights, or decisions you make based on the service.

14. Responsible Gambling Notice

Basketball Alpha is not a gambling service, but the service may be used by people who choose to engage in sports betting through independently licensed sportsbooks. If you choose to bet, do so only where legal, only if you are legally eligible, and never risk more than you can afford to lose.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law rules. Before filing a formal claim, you agree to first contact Basketball Alpha at the email below and attempt to resolve the dispute informally.

If a dispute cannot be resolved informally, you and Basketball Alpha agree that the state and federal courts located in Kansas will have exclusive jurisdiction and venue, except where applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will post the updated Terms on this page and update the effective date. Continued use of Basketball Alpha after updated Terms are posted means you accept the updated Terms going forward.
